PLEASE READ THESE TERMS OF USE CAREFULLY AS THEY CONTAIN IMPORTANT INFORMATION REGARDING YOUR LEGAL RIGHTS, REMEDIES AND OBLIGATIONS. BY SUBMITTING A COMMENT TO HRT YOU AGREE TO BE BOUND BY THE FOLLOWING TERMS AND CONDITIONS.
By submitting any comment in any format to the Transportation District Commission of Hampton Roads t/a Hampton Roads Transit (“HRT”), the HRT website, social media platforms or any other forum, you hereby waive any privacy expectation that you may have with respect to such submission, including, but not limited to, any comments, photos, videos, data, metadata or any other information submitted by you to HRT.
You acknowledge and agree that any submission made by you to HRT may be subject to the Virginia Freedom of Information Act or otherwise made available by HRT for public review and comment. You acknowledge and agree that once a submission is made by you, HRT will have no obligation to remove, delete, or return the submission. To the fullest extent permitted by law, you grant HRT an irrevocable, non-exclusive, royalty-free, and transferable license to use, reproduce, distribute, or display your submission in any media formats and through any media channels that exist now or may be developed in the future for the promotion of HRT’s business and services.
You warrant that your submission does not contain any material that is copyrighted, protected by trade secret or otherwise subject to third party proprietary rights, including privacy and publicity rights, unless you are the owner of such rights or have permission from their rightful owner to post the material.
You agree not to make a submission that contains:
- Offensive, derogatory, vulgar or obscene language or material;
- Libelous, harassing or abusive language or material; or
- Personal information or likenesses of other persons without their consent.
You agree that HRT has the sole and plenary power to determine whether your submission contains prohibited content or otherwise violates these Terms and Conditions. In the event a submission is determine by HRT to contain prohibited content, HRT may, in its sole discretion, restrict or prohibit further comment by you on the HRT website or other platforms.
YOU AGREE TO INDEMNIFY AND HOLD HRT HARMLESS FROM AND AGAINST ANY AND ALL LOSSES, LIABILITIES, ATTORNEY’S FEES, COSTS AND EXPENSES ARISING OUT OF OR RELATED TO ANY BREACH OF THESE TERMS AND CONDITIONS.
